Welcome to Mentel. These Terms of Use (“Terms”) govern your access to and use of the Mentel website, including any content, functionality, and services made available through the website (the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, do not use the Site.

1. Who We Are

Mentel is a digital platform and brand that provides information about mental health services and may facilitate access to services offered by licensed professionals and/or affiliated professional entities.

Important: The Site itself is not a substitute for medical advice, diagnosis, or emergency care. If you are experiencing a medical or mental health emergency, call 911, go to the nearest emergency room, or call/text 988.

2. Scope of These Terms

These Terms govern your use of the Site. They do not replace or modify any separate:

  • patient consent forms,
  • telehealth consent forms,
  • financial policies,
  • notices of privacy practices,
  • provider-patient agreements, or
  • other clinical documents you may receive if you become a patient.

If you receive services from a licensed provider or affiliated practice, additional terms and clinical policies may apply.

3. Eligibility

You must be at least 18 years old to use the Site on your own behalf, unless you are using the Site under the supervision or authority of a parent, legal guardian, or other legally authorized representative.

By using the Site, you represent that:

  • you have the legal capacity to enter into these Terms; and
  • any information you submit is true, accurate, and complete.

4. No Emergency Services

The Site and any communications through the Site are not intended for emergency or crisis situations.

Do not use the Site to seek urgent help for:

  • suicidal thoughts,
  • threats of harm to self or others,
  • severe psychiatric symptoms,
  • medical emergencies, or
  • any condition requiring immediate attention.

In an emergency, call 911 or go to the nearest emergency room. You may also call or text 988 for the Suicide & Crisis Lifeline.

5. No Medical Advice Through the Website

Content on the Site is provided for general informational purposes only. Nothing on the Site should be interpreted as medical advice, diagnosis, or treatment, and use of the Site does not by itself create a provider-patient relationship.

A provider-patient relationship is formed only when you are accepted as a patient by the appropriate licensed professional or professional practice and all applicable intake, consent, and clinical requirements have been completed.

6. Telehealth and Professional Services

If you choose to pursue professional services through Mentel or an affiliated practice, those services may be delivered by telehealth where legally permitted and clinically appropriate.

Telehealth and professional services are subject to separate clinical and legal requirements, including provider licensure, patient location, consent, and professional judgment. Services may be limited based on your location and the provider’s ability to lawfully and appropriately treat you.

7. Account Registration and Security

Some features of the Site may require you to create an account or submit information.

You agree to:

  • provide current, accurate, and complete information;
  • maintain the confidentiality of your login credentials;
  • promptly update any information that changes; and
  • notify us immediately of any suspected unauthorized use of your account.

You are responsible for activity occurring under your account to the extent caused by your failure to safeguard your credentials.

8. Acceptable Use

You agree not to:

  • use the Site in violation of any applicable law or regulation;
  • impersonate any person or entity;
  • submit false, misleading, or fraudulent information;
  • interfere with or disrupt the operation or security of the Site;
  • attempt to gain unauthorized access to any systems or data;
  • use automated tools to scrape, harvest, or copy Site content without permission;
  • transmit malicious code, viruses, or harmful material;
  • harass, threaten, abuse, or otherwise harm Mentel personnel, providers, or other users.

We may suspend, restrict, or terminate access to the Site if we believe you have violated these Terms or used the Site in a way that creates legal, operational, or safety risk.

9. Scheduling, Insurance, and Payment Information

If the Site includes scheduling, insurance, billing, or payment features, the following apply:

  • Insurance eligibility and benefits are not guaranteed by Mentel.
  • You are responsible for reviewing your coverage, including deductibles, copayments, coinsurance, non-covered services, and network status.
  • Any quotes, estimates, or eligibility information shown through the Site are informational only and may change.
  • Additional financial terms may apply if you become a patient and will be provided separately.

10. Privacy

Your use of the Site is also governed by our Privacy Policy.

If you become a patient of a HIPAA-covered provider or affiliated practice, your protected health information will be handled in accordance with the applicable Notice of Privacy Practices and governing law.

11. Intellectual Property

The Site and all content on it, including text, graphics, logos, icons, images, audio, video, software, layout, and design elements, are owned by Mentel, its licensors, or other content providers and are protected by applicable intellectual property laws.

Subject to these Terms, Mentel grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use.

You may not:

  • copy, reproduce, distribute, publish, display, modify, create derivative works from, sell, license, or exploit Site content without prior written permission, except as permitted by law.

12. Third-Party Services and Links

The Site may contain links to third-party websites, tools, scheduling systems, payment processors, electronic health record systems, pharmacies, or other services not owned or controlled by Mentel.

Mentel is not responsible for the content, availability, security, policies, or practices of third-party services. Your use of third-party services is governed by their own terms and privacy policies.

13. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

Mentel does not warrant that:

  • the Site will always be available, uninterrupted, timely, secure, or error-free;
  • defects will be corrected;
  • the Site or its servers are free of viruses or harmful components; or
  • the Site content is complete, current, or suitable for every purpose.

Nothing in these Terms is intended to disclaim any duty or obligation that cannot lawfully be disclaimed under applicable law.

14. Limitation of Liability

To the fullest extent permitted by law, Mentel and its owners, officers, employees, contractors, licensors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site.

To the fullest extent permitted by law, Mentel’s total liability for claims arising out of or relating to the Site will not exceed the greater of:

  • the amount you paid, if any, to use the specific Site feature giving rise to the claim, or
  • one hundred U.S. dollars ($100).

Nothing in these Terms limits liability where such limitation is prohibited by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Mentel and its owners, officers, employees, contractors, licensors, affiliates, and agents from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your violation of these Terms;
  • your misuse of the Site;
  • your infringement of another party’s rights; or
  • information or content you submit through the Site.

16. Changes to the Site

We may modify, suspend, discontinue, or restrict access to any part of the Site at any time, with or without notice, to the extent permitted by law.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version on the Site and update the Effective Date above. Your continued use of the Site after revised Terms are posted constitutes your acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, except to the extent superseded by applicable federal law.

19. Jurisdiction and Venue

Any legal action arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in New York County, New York, unless applicable law requires otherwise, and you consent to the personal jurisdiction of those courts.

20. Severability

If any provision of these Terms is found unenforceable or invalid, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with any documents expressly incorporated by reference, constitute the entire agreement between you and Mentel regarding your use of the Site.
